We also prosecute debt collectors who violate the Telephone Consumer Protection Action (TCPA) when they make unauthorized telephone calls to a consumer’s cell phone.

We sue debt collectors for violating collection laws, including the federal Fair Debt Collection Practices Act (FDCPA) and the California Fair Debt Collection Practices Act (Rosenthal Act). We also represent consumers who have suffered damages as a result of credit reporting agencies violating the Fair Credit Reporting Act (FCRA) when credit reporting agencies fail to correct an error on a credit report after the error has been pointed out to the credit reporting agency.

Debt collection companies rely on defendant not fighting the lawsuit. We provide complete legal representation to such litigations by providing counsel, guidance and full representation. Our representation includes initial attempts to settle a matter, and if settlement is not immediately reached, we engage in complete representation including taking the case to trial.

The Law Office of Nicolás C. Vaca understands and appreciates that not everyone may want to retain an attorney to represent them in their matter. For those individuals, we have a self-help section that includes letters that can be used when you are initially contacted by a debt collector. These response letters provide protection from a debt collector even before any litigation is initiated.

By filing and serving an answer to a complaint, a litigant can protect themselves from suffering a default judgment and give notice to the debtor collector that the matter will be fought.
